We have a global offering, and currently administer loans created under the laws of Argentina, Brazil, Canada, Chile, Germany, the Netherlands, Indonesia, Malaysia, New York, Singapore, Switzerland and the UK, among others.

We use industry-leading loan management software to maintain information and payment flows and our deep relationships with asset managers, banks, borrowers and funds helps ensure the efficient administration of a credit.

As an independent service provider, we offer a conflicts-free third party option, both from day one and as a successor administrative agent, in particular on a defaulted syndicated loan or multi-lender credit.

We act as collateral agent, security agent, security trustee and Latin American “agente de garantias” and “fiduciario” across all types of secured bonds and loans.

On multi-jurisdictional deals, we allocate the TMF Group office in the jurisdiction of the law governing the credit as the “global agent” and it appoints our offices in the location of the applicable collateral to each act as local collateral agent.

This ensures the borrower and lenders have a single point of contact and that the collateral is held by an experienced local team, with established service provider relationships. The global agent structure includes a coordination function which enables the parties to avoid any disconnect between the local collateral administration and the credit facility. The use of local offices from the outset of a transaction also ensures optimal efficiency in the event of a default or restructuring.
